1: Warranty Application

For warranty to apply, proper authorization MUST be obtained prior to performing any repairs. This warranty is void if the product is repaired or altered in any way other than by those persons or agencies recommended by Toyesi Pty. Ltd. 2: Scope of Warranty

Toyesi Pty. Ltd. warrants to the original owner that its heat pump, when installed by a qualified licensed installer, will be free of defects in its materials and workmanship under normal use and service.

If a defect appears in the product before the end of the warranty period and Toyesi finds the product to be defective in material or workmanship, Toyesi will, in its sole discretion, either:

(a)   Repair or replace the product or defective part of the product free of charge; or

(b)   Cause the product or the defective part of the product to be replaced or repaired by an authorized Toyesi approved service agent free of charge.

Toyesi reserves the right to replace defective parts of the product with parts and components of similar quality, grade and composition where an identical part or component is not available.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

3: Warranty Period

Toyesi Pty. Ltd. warrants that, subject to the exclusions and limitations below, that the heat pump will be free from defects in materials and workmanship during the warranty period. The warranty periods are set out below and commence 30 days after the date of leaving Toyesi’s factory (to allow for delivery & installation). The warranty period may vary for different parts of the heat pump.

4: Warranty Claims

(a)   If a fault covered by warranty occurs, the customer must first contact Toyesi (02 9679 9400 or toyesi@toyesi.com.au) or via this websites contact us page. Or via an Authorised Toyesi Service Agent.

(b)   Any warranty claim must be accompanied by

  1. Proof of purchase
  2. Full details of the alleged defect
  3. Supporting information such as the serial number and model number of the product.
  4. Historical or maintenance records, for both the unit and water quality records, will be required.

(c)   The customer must make the product available to Toyesi or its authorised Toyesi Service Agent for inspection and testing. Toyesi or its authorized service agent will attend the premises where the product is installed for inspection and testing.

(d) The customer may have to pay for travel costs, or back to base shipping costs if:

  1. They are outside of the Sydney Metropolitan area if they require Toyesi to do the warranty work.
  2. Outside of a capital city metropolitan area for an authorised service, agent to do the warranty work, or
  3. is not within a 20 km radius of an Authorised Service Agent.

(e)   If such inspection and testing find no defect in the product, the customer must pay Toyesi usual costs of service work and testing, including parts. If such inspection and testing find a defect that is not covered by this warranty, the customer must pay Toyesi standard industry costs of service call out, work, travel, plus any parts and labour required to repair the product, unless recoverable from Toyesi on the failure of any statutory guarantee under the ACL.

5: Warranty Exclusions

This limited warranty does not apply if:

(a)   The product has been moved from its original place of installation, or if the original owner no longer owns the property where the original installation was made;

(b)   The product is modified in any way, or non-factory authorised accessories, components or controllers are fitted or used in conjunction with the product;

(c)   The product is not properly installed and commissioned by a qualified licensed installer in accordance with applicable pool and spa codes of practice, or relevant codes of practice where not installed in a pool or spa situation, and where failure to adhere to Toyesi’s installation instructions, including but not limited to:

  1. installing after salt chlorine generators or any other electrical or chemical discharge device;
  2. placing chemicals in the skimmer box as this will feed concentrated chemical or chlorine directly into the heat exchanger before it is diluted;
  3. allowing the heat pump to operate when automatic suction or vacuum type pool cleaners are being used when granulated type chemicals are being added to, or are sitting on the floor of the pool and/or spa
  4. allowing a three-phase heat pump to operate with incorrect supply phase rotation
  5. allowing the heat pump to operate on an unstable power supply or voltage surge.
  6. Incorrect or insufficient ventilation. E.g A Heat Pump installed in a confined space, with a lack of ventilation- Causing re-circulation of discharge cold air back into the heat pump. This can cause freeze-ups, and reduced system efficiency.

(d)   The product is not operated, nor properly maintained (with service documentation): domestic 2 times, Commercial 4 times a year (seasonally), in accordance with these instructions, including but not limited to:

  1. freeze-ups;
  2. neglecting to properly maintain filtration and reticulation equipment in accordance with manufacturer’s instructions;
  3. having either air or water flow restrictions, fluctuations or obstructions; i.e blocked water circulating pump.
  4. operating the product with cabinet doors removed;
  5. operating the product with improper water balance setting;
  6. operating without a proper chemical balance of:
    • pH ~ 7.2 to 7.6 (7.0 to 7.2 – fiberglass pools)
    • Free Chlorine ~ 1.0 to 2.0 p.p.m
    • Total Alkalinity ~ 100 to 120 p.p.m
    • Calcium Hardness ~ 200 to 350 p.p.m
    • Total Dissolved Solids ~ less than 3000 p.p.m

(e)   The rating plate or serial number is altered or removed;

(f)   To damage from abuse, misuse or neglect

(g)   The pool is not properly earthed to prevent electrolysis.

(h)   The customer is in breach of the Terms and Conditions of Sale;

(i)   The product was used for a purpose other than one it was intended for;

(j)   The warranty does not extend to:

  1. Normal wear and tear;
  2. Service and maintenance items
  3. Installations in countries outside of Australia and its associated territories.
  4. Acts of nature, accident, fire, flood, freeze or heat waves and the like;
  5. Accidental damage in transit or during installation.
  6. Intentional damage or sabotage.

6: Commercial Installations

On commercial installations, such as health clubs, motels, hotels, and hydrotherapy facilities, the warranty (unless listed otherwise below) is limited to parts and labour (within capital city metropolitan areas or 20 km radius of Authorised Service Agents) for a period of 12 months from the date of leaving Toyesi factory plus 30 days to allow for installation.

7: Limitation of Liability

This is the only warranty given by Toyesi Pty. Ltd. No one is authorised to make any other warranties on our behalf.

Toyesi shall have no liability whether under this warranty or in contract, tort or negligence or otherwise for claims for special, incidental or consequential damages, including no liability for damage from water leakage, condensate build-up, electrical discharge etc.

The repair or replacement of the Product or part of the product is the absolute limit of Toyesi’s liability under this express warranty.

This document has been put together under OE&E guidelines and Toyesi holds the right to make changes, without notice, if an error or omission has been observed.
